Terms & Conditions
Welcome to Winning Edge Cycling. This website is owned and operated by Anna-Leeza Hull, trading as Winning Edge Cycling (NZBN 9429048866446), a sole trader based in Tauranga, New Zealand.
These Website Terms and Conditions (Terms) govern your access to and use of our website, including its content, features, enquiries, appointment bookings and online purchasing functionality.
By accessing or using our website, you agree to comply with these Terms to the extent applicable to your use. If you do not agree with these Terms, please discontinue your use of the website.
1. Introduction
1.1. Winning Edge Cycling provides information about cycling coaching, athlete development, performance education and associated services and resources.
1.2. Our website enables visitors to learn about our services, submit enquiries, schedule appointments and purchase eligible services through third-party payment platforms.
1.3. These Terms govern the use of our website. Where you purchase or participate in a coaching service, additional terms and conditions may apply through a separate coaching agreement or service-specific purchase terms.
1.4. Where a separate coaching agreement applies, that agreement governs the provision of the relevant coaching services. These Website Terms continue to apply to your use of the website.
1.5. Our collection, use, storage and disclosure of personal information is addressed in our Privacy Policy, which should be read alongside these Terms.
1.6. Nothing in these Terms excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under applicable New Zealand legislation.
2. Eligibility of the User
2.1. Our website may be accessed by individuals of any age, provided they use the website lawfully and comply with these Terms.
2.2. Individuals aged 18 years or older may independently enquire about, purchase and enter into agreements for our coaching services, subject to any applicable eligibility requirements.
2.3. Individuals under 18 years of age may participate in our coaching services only where written consent has been provided and signed by a parent or legal guardian before the commencement of coaching.
2.4. Where an individual under 18 years of age wishes to purchase or participate in a coaching service, the relevant parent or legal guardian must review and sign the applicable coaching agreement and any required consent documentation.
2.5. We reserve the right to request reasonable verification of age, identity or parental or guardian authority where necessary to establish eligibility for our services.
2.6. We reserve the right to decline or restrict access to our services where eligibility requirements have not been satisfied, subject to applicable laws and consumer rights.
2.7. All users must comply with applicable laws and regulations when accessing or using our website.
3. Services, Purchases and Initial Coaching Consultations
3.1. Winning Edge Cycling provides information about cycling coaching, athlete development, performance education and associated services through its website.
3.2. Our website allows users to explore coaching services and educational resources, submit enquiries, schedule consultations or appointments, and purchase eligible services through third-party payment providers.
3.3. Customers may purchase eligible individualised coaching services directly through our website without completing an initial consultation beforehand. Customers may also contact Winning Edge Cycling to discuss their requirements before purchasing.
3.4. Where an individualised coaching service is purchased before an initial consultation, Winning Edge Cycling will arrange a consultation to discuss the athlete's goals, circumstances, expectations and suitability for the selected service.
3.5. Following the initial consultation, the customer may choose not to proceed with coaching. Where cancellation is requested before the commencement of the athlete's onboarding assessment or other individualised coaching services, Winning Edge Cycling will provide a full refund of the coaching fees paid.
3.6. For the purposes of Section 3.5, the commencement of the onboarding assessment means the point at which the customer has confirmed their decision to proceed and authorised Winning Edge Cycling to begin the individualised assessment process. Merely receiving onboarding documents does not, by itself, constitute commencement of the assessment.
3.7. Where Winning Edge Cycling determines that the selected coaching service is unsuitable or cannot reasonably be provided, we will discuss appropriate alternatives with the customer. If no suitable arrangement is agreed upon, a full refund of the coaching fees paid will be provided.
3.8. Once the customer confirms their decision to proceed and individualised coaching services commence, the cancellation and refund provisions of the applicable coaching agreement will apply, subject to relevant consumer protection laws.
3.9. The initial consultation cancellation policy in Sections 3.4–3.8 applies to eligible individualised coaching services. Self-guided programmes, digital products and other services may have different cancellation and refund conditions, which will be disclosed before purchase.
3.10. The price, scope, payment arrangements, cancellation conditions and other material terms applicable to a service will be made available to the customer before purchase. Where a separate coaching agreement is required, customers will be provided with the applicable agreement and any required consent documentation before individualised coaching commences.
3.11. Information provided on our website, including descriptions of coaching programmes, educational materials and athlete development resources, is intended for general informational purposes and does not constitute individualised coaching, medical advice or professional healthcare advice.
3.12. We endeavour to ensure that information about our services is accurate and current. However, we may update, modify or discontinue services advertised on our website, subject to existing contractual obligations and applicable consumer protection laws.
3.13. Accessing our website, submitting an enquiry or scheduling an initial consultation does not, by itself, establish an ongoing coaching relationship or create an obligation for Winning Edge Cycling to provide individualised coaching services.
3.14. Nothing in this section excludes, restricts or modifies any statutory rights or remedies available under applicable New Zealand legislation.

4.5. You are responsible for ensuring that any information or materials you submit through our website do not infringe the rights of another person or breach applicable laws.
4.6. We reserve the right to restrict or suspend access to our website where we reasonably believe that a user has breached these Terms, compromised website security or engaged in unlawful conduct, subject to applicable laws.

6.7. Where our website refers to scientific research, established training principles or other publicly available knowledge, we do not claim exclusive ownership of those underlying concepts or information. Our intellectual property rights relate to the original expression, arrangement, design, resources and other protectable elements developed by Winning Edge Cycling.
6.8. Any intellectual property rights or permissions relating to materials supplied as part of a purchased coaching service are governed by the applicable coaching agreement or any additional licence terms provided with those materials.
6.9. If you believe that content published on our website infringes your intellectual property rights, please contact us using the details provided in these Terms.
7. Privacy and Personal Information
7.1. Winning Edge Cycling respects your privacy and is committed to handling personal information in accordance with the New Zealand Privacy Act 2020 and other applicable privacy laws.
7.2. We may collect personal information when you interact with our website, including when you submit an enquiry, schedule an appointment, purchase a service, subscribe to marketing communications or otherwise contact us.
7.3. We use third-party service providers to support the operation of our website and associated business activities, including Webflow, Stripe, Klaviyo, Google Analytics, Microsoft 365 and Calendly. These providers may collect, process or store personal information in connection with the services they provide.
7.4. Our collection, use, storage, disclosure and protection of personal information is explained in our Privacy Policy, which is available on our website and should be read alongside these Terms.
7.5. Where additional personal information is required for the provision of coaching services, including health, training, nutrition or performance information, the collection and handling of that information will be addressed through the applicable athlete onboarding documentation and associated privacy information.
7.6. You are responsible for ensuring that any personal information you provide through our website is accurate and that you have appropriate authority to provide information relating to another individual.
7.7. You may request access to, or correction of, personal information held about you in accordance with the Privacy Act 2020. Requests may be submitted using the contact details provided in these Terms.
7.8. We will take reasonable steps to protect personal information against loss, misuse, unauthorised access, modification and disclosure, in accordance with our Privacy Policy and applicable legal obligations.
8. Relationship Between the Parties
8.1. Accessing or using the Winning Edge Cycling website does not establish an employment, partnership, joint venture, agency or other formal business relationship between you and Winning Edge Cycling.
8.2. Submitting an enquiry, subscribing to communications or scheduling an initial consultation through our website does not, by itself, establish an ongoing coaching relationship or create an obligation for Winning Edge Cycling to provide individualised coaching services.
8.3. Where you purchase or engage Winning Edge Cycling to provide coaching services, the nature, scope and conditions of the coaching relationship will be governed by the applicable coaching agreement and any purchase terms accepted by the customer.
8.4. Nothing in these Terms authorises you to act on behalf of Winning Edge Cycling, represent yourself as an employee, agent or authorised representative of the business, or enter into commitments on its behalf without prior written authorisation.
8.5. Nothing in this section limits any rights or obligations that arise under an applicable coaching agreement, purchase terms or relevant New Zealand law.
9. Indemnity
9.1. To the extent permitted by applicable law, you agree to indemnify Winning Edge Cycling against reasonable and direct losses, liabilities, damages, costs and expenses arising from:
- your deliberate or unlawful misuse of our website;
- your unauthorised access to, interference with or deliberate disruption of our website, systems or associated services;
- your infringement of the intellectual property rights, privacy rights or other legal rights of a third party through your use of our website; or
- fraudulent or intentionally misleading information submitted by you through our website that causes loss to Winning Edge Cycling.
9.2. Any indemnity under this section applies only to the extent that the relevant loss, liability, damage, cost or expense is directly caused by your conduct described in Section 9.1.
9.3. You are not required to indemnify Winning Edge Cycling for any loss or liability arising from our own negligence, unlawful conduct, breach of these Terms or failure to comply with applicable legal obligations.
9.4. Nothing in this section excludes, restricts or modifies any rights or remedies available to you under the Consumer Guarantees Act 1993, Fair Trading Act 1986 or any other applicable New Zealand legislation where those rights or remedies cannot lawfully be excluded, restricted or modified.
10. Website Information and Educational Content
10.1. Information published on the Winning Edge Cycling website, including content relating to cycling training, strength and conditioning, nutrition, athlete development, recovery and performance, is provided for general informational and educational purposes.
10.2. While we endeavour to ensure that website information is accurate, relevant and informed by appropriate professional knowledge and available evidence, general information may not be suitable for every individual or circumstance.
10.3. Information available on our website does not constitute individualised coaching, medical advice, diagnosis, treatment or other regulated healthcare services. It should not be relied upon as a substitute for advice from an appropriately qualified healthcare professional where such advice is required.
10.4. Individual responses to exercise, training, nutrition and other performance-related practices vary. Users should consider their personal circumstances, health status, experience and capabilities before applying general information obtained from our website.
10.5. Where appropriate, users should seek guidance from a suitably qualified professional before commencing or substantially modifying an exercise, training or nutrition programme, particularly where they have existing health concerns, injuries or other circumstances requiring individual consideration.
10.6. Any examples, testimonials, case studies or performance outcomes presented on our website illustrate individual experiences and results. They do not constitute a guarantee that other individuals will achieve the same or similar outcomes.
10.7. Accessing or applying general information published on our website does not establish an individualised coaching relationship. Where coaching services are purchased, the scope of those services and the respective responsibilities of Winning Edge Cycling and the client are governed by the applicable coaching agreement.
10.8. Nothing in this section excludes, restricts or modifies any rights, guarantees or remedies that cannot lawfully be excluded under applicable New Zealand legislation.
11. Limitation of Liability
11.1. Winning Edge Cycling takes reasonable care in operating and maintaining its website and providing information about its services. However, we do not guarantee that the website will be continuously available, uninterrupted, error-free or free from technical difficulties.
11.2. From time to time, access to our website or certain features may be interrupted, restricted or unavailable due to maintenance, technical issues, third-party service disruptions or circumstances beyond our reasonable control.
11.3. To the extent permitted by applicable law, Winning Edge Cycling will not be liable for losses arising solely from temporary website unavailability, technical interruptions or circumstances beyond our reasonable control, except where such losses result from our failure to meet applicable legal obligations.
11.4. Our website may incorporate or provide access to third-party services, including payment processing, appointment scheduling and external websites. While we take reasonable care in selecting and using service providers, we do not control every aspect of their systems, availability, content or operations.
11.5. To the extent permitted by applicable law, Winning Edge Cycling is not responsible for losses directly attributable to the independent acts, omissions or technical failures of third-party providers, except where we are legally responsible for those losses.
11.6. We endeavour to provide accurate and current information on our website. However, website content may occasionally contain errors, omissions or outdated information. We reserve the right to correct or update such information, subject to our contractual obligations and applicable consumer protection laws.
11.7. Any liability arising from the purchase or delivery of coaching services will be considered in accordance with the applicable coaching agreement, applicable purchase terms and relevant law. Nothing in these Website Terms overrides rights or obligations already established under a separate coaching agreement.
11.8. Nothing in these Terms excludes, restricts or modifies any consumer guarantees, statutory rights, remedies or liabilities that cannot lawfully be excluded, restricted or modified, including those arising under the Consumer Guarantees Act 1993 and Fair Trading Act 1986.
11.9. Where Winning Edge Cycling is legally responsible for a loss or damage, any limitation of liability under these Terms applies only to the extent permitted by applicable law.
12. Restriction or Termination of Website Access
12.1. Winning Edge Cycling reserves the right to restrict, suspend or terminate an individual's access to its website, or particular website features, where reasonably necessary to protect the security, integrity or lawful operation of the website.
12.2. We may take such action where we reasonably believe that an individual has:
- breached these Terms;
- used the website for unlawful, fraudulent or intentionally misleading purposes;
- attempted to gain unauthorised access to website systems, information or associated services;
- interfered with or compromised website security, functionality or availability;
- infringed the intellectual property rights, privacy rights or other legal rights of Winning Edge Cycling or another party; or
- engaged in conduct that presents a material security, legal or operational risk.
12.3. Any restriction, suspension or termination of website access will be proportionate to the circumstances and undertaken in accordance with applicable law.
12.4. Where reasonably practicable and appropriate, we may provide notice of a restriction or suspension and an opportunity to address the relevant issue. However, immediate action may be taken where necessary to prevent unlawful activity, security threats or significant disruption.
12.5. Restriction or termination of website access does not automatically terminate an existing coaching agreement. Any suspension, cancellation or termination of coaching services will be governed by the applicable coaching agreement and relevant law.
12.6. Restriction or termination of website access does not affect any rights, obligations or remedies that have already arisen under these Terms, an applicable coaching agreement or relevant legislation.
12.7. Nothing in this section excludes, restricts or modifies any statutory rights or remedies that cannot lawfully be excluded, restricted or modified.
13. Effects of Termination
13.1. Where an individual's access to the Winning Edge Cycling website is restricted, suspended or terminated under Section 12, that individual must comply with the applicable restriction and must not attempt to circumvent any reasonable security or access measures implemented by Winning Edge Cycling.
13.2. Restriction, suspension or termination of website access does not transfer, waive or otherwise affect the intellectual property rights of Winning Edge Cycling or any third party.
13.3. Any provisions of these Terms that, by their nature, are intended to continue after website access ends will remain applicable to the extent permitted by law. These may include provisions relating to intellectual property, privacy, liability, indemnity and dispute resolution.
13.4. Any existing coaching agreement will remain subject to its own terms and conditions. Restriction or termination of website access does not, by itself, cancel a coaching agreement or alter any rights or obligations arising under that agreement.
13.5. Any outstanding payments, refunds or other obligations relating to purchased services will be determined in accordance with the applicable coaching agreement, relevant purchase terms and New Zealand law.
13.6. Any personal information collected before website access is restricted or terminated will continue to be handled in accordance with our Privacy Policy and applicable privacy laws.
13.7. Nothing in this section limits any statutory rights, guarantees or remedies available under applicable New Zealand legislation.
14. Governing Law and Dispute Resolution
14.1. These Website Terms and Conditions are governed by and interpreted in accordance with the laws of New Zealand.
14.2. Any dispute arising from or relating to the use of the Winning Edge Cycling website or these Terms will be addressed in accordance with applicable New Zealand law.
14.3. If a dispute arises, we encourage you to contact Winning Edge Cycling in the first instance so that we have an opportunity to understand the concern and work towards a reasonable resolution.
14.4. We will endeavour to respond to complaints and disputes within a reasonable timeframe and engage in good faith to resolve matters where possible.
14.5. Where a dispute cannot be resolved through direct communication, either party may pursue available dispute resolution procedures or legal remedies through an appropriate New Zealand court, tribunal or other competent authority.
14.6. Nothing in these Terms prevents you from exercising any rights or remedies available under New Zealand law, including the Consumer Guarantees Act 1993, Fair Trading Act 1986 and Privacy Act 2020.
14.7. Where a dispute relates specifically to the purchase or delivery of coaching services, the dispute resolution provisions of the applicable coaching agreement will also apply, subject to relevant legislation and any statutory rights that cannot lawfully be excluded.
15. Third-Party Websites and Services
15.1. The Winning Edge Cycling website may contain links to external websites or integrate services operated by third-party providers, including payment processing, appointment scheduling and other website functionality.
15.2. Third-party services used in connection with our website may include Stripe for payment processing, Calendly for appointment scheduling, and other providers that support the operation and functionality of our website.
15.3. When you access or use a third-party website or service, you may be subject to that provider's own terms and conditions, privacy policy and other applicable policies. We encourage you to review these documents before providing personal information or completing a transaction.
15.4. Winning Edge Cycling does not control the independent operation, security, availability or content of third-party websites and services. While we take reasonable care in selecting providers used in our business operations, we cannot guarantee that their services will always be available or free from technical difficulties.
15.5. Links to external websites, including educational resources, research publications or other third-party content, are provided for informational or convenience purposes. Unless expressly stated otherwise, the inclusion of a link does not constitute an endorsement, partnership or affiliation with the relevant third party.
15.6. Where you purchase a Winning Edge Cycling service through a third-party payment provider, the use of that provider does not alter the identity of Winning Edge Cycling as the supplier of the purchased service or remove any rights or obligations arising under the applicable coaching agreement and New Zealand law.
15.7. Winning Edge Cycling remains responsible for meeting its own legal obligations in connection with third-party services, including applicable consumer protection and privacy requirements.
15.8. Nothing in this section excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under applicable New Zealand legislation.

16.5. You are responsible for providing accurate contact information and notifying us of any relevant changes where ongoing communication is required.
16.6. Marketing communications will be managed separately from essential service-related communications. Where required by law, we will obtain appropriate consent before sending commercial electronic messages and provide a means of unsubscribing from marketing communications.
16.7. Where a separate coaching agreement specifies particular requirements for formal notices or communications, those requirements will apply to matters governed by that agreement.
16.8. Nothing in this section limits any legal requirements relating to the form, delivery or receipt of notices under applicable New Zealand legislation.
17. Amendments to the Terms and Conditions
17.1. Winning Edge Cycling may review and amend these Website Terms and Conditions from time to time to reflect changes to our website, services, business operations, legal obligations or other relevant circumstances.
17.2. Where these Terms are amended, the updated version will be published on our website with a revised "Last updated" date.
17.3. Unless otherwise stated, amendments will take effect from the date the updated Terms are published and will apply to subsequent use of our website.
17.4. Where an amendment materially affects the rights or obligations of users, we will take reasonable steps to communicate the change where appropriate and practicable, having regard to the nature of the amendment and the individuals affected.
17.5. Amendments to these Website Terms will not automatically modify an existing coaching agreement or retrospectively alter the terms of a completed purchase. Any changes to an existing coaching agreement must be made in accordance with that agreement and applicable law.
17.6. By continuing to use our website after amended Terms take effect, you agree to comply with the updated terms to the extent that they are lawfully applicable to your subsequent website use. Continued use does not, by itself, constitute acceptance of changes to an existing coaching agreement.
17.7. Nothing in this section permits Winning Edge Cycling to make amendments that unlawfully exclude, restrict or modify statutory rights, consumer guarantees or other protections available under New Zealand law.
18. Force Majeure
18.1. Winning Edge Cycling will not be responsible for a delay or failure to perform website-related obligations under these Terms to the extent that the delay or failure is directly caused by circumstances beyond our reasonable control, provided we have taken reasonable steps to prevent or minimise the impact of those circumstances.

- natural disasters, earthquakes, floods, fires or severe weather events;
- epidemics, pandemics or public health emergencies;
- war, terrorism, civil unrest or other significant public emergencies;
- widespread electricity, telecommunications or internet infrastructure failures;
- significant cyberattacks or disruptions to essential third-party technology services that could not reasonably have been prevented; or
- government actions, restrictions or other events beyond our reasonable control that materially affect website operations.
18.3. Where such circumstances affect the operation of our website, we will take reasonable steps to minimise disruption and restore affected services as soon as reasonably practicable.
18.4. Where reasonably possible, we will communicate significant disruptions that materially affect website functionality, appointment bookings or purchasing processes.
18.5. This section does not automatically excuse obligations relating to coaching services purchased under a separate coaching agreement. Any interruption, postponement, cancellation, refund or other consequence affecting those services will be addressed in accordance with the applicable coaching agreement and relevant law.
18.6. Nothing in this section excludes, restricts or modifies any statutory rights, consumer guarantees, remedies or legal obligations that cannot lawfully be excluded, restricted or modified under New Zealand legislation.
